Countersuit says third title is in "pre-production."

Perhaps the biggest news from Activision's countersuit filed this morning against former Infinity Ward executives Jason West and Vince Zampella is the mention of Modern Warfare 3.

According to the countersuit, West and Zampella entered into a Memorandum of Understanding (MOU), an agreement between two parties, with Activision and Infinity Ward in connection with Modern Warfare 2 and "any subsequent Infinity Ward projects" back in March 2008. This MOU apparently included certain rights for Modern Warfare 3, which Activision says in its countersuit that development for the third title was delayed intentionally by West and Zampella in order to leverage their rights under the MOU to "obtain further advantages for themselves and concessions" from Activision.

"West and Zampella contend that, pursuant to the MOU, so long as they were employed at IW, their written consent was required for certain decisions related to the Modern Warfare brand," the countersuit says. "As a result of the implied covenant of good faith and fair dealing, West and Zampella were prohibited from withholding such consent unreasonably or in bad faith."

"Nevertheless, prior to the termination of their employment with Activision, West and Zampella unreasonably and/or in bad faith refused to provide this consent in an effort to gain an unfair advantage in negotiations with Activision and in an improper attempt to gain an advantage for themselves in connection with their plan to leave Activision and establish their own company," the suit states.

"Among other things, they delayed pre-production of Modern Warfare 3 and attempted to improperly leverage their rights under the MOU to obtain further advantages for themselves and concessions from Activision."

The countersuit continues on to say Activision has had to spend additional development costs for the project due to Zampella and West breaching the MOU.

"As a direct and proximate result of this breach of the covenant of good faith and fair dealing, Activision has been forced to commit additional resources to Modern Warfare 3, institute litigation to seek a declaration of rights, and incur costs and attorneys' fees, and will incur additional expenses in connection with securing the benefits of the MOU."

"Accordingly, Activision has been damaged as a result of West and Zampella's actions in an amount to be proven at trial."

An Activision representative told IGN the company has no additional comments about the development of Modern Warfare 3.

Αν βγει το BF3 το 2011, το modern warfail 3 θα πάει εκεί που πήγε και το modern warfail 2 όσον αφορά τις πωλήσεις στο PC (δλδ στον ΠΑΤΟ).

Το ακριβως αντιθετο το mw2 πετυχε στις πωλησεις και το bc2 δεν νομιζω να το εχει περασει στις πωλησεις και ουτε θα το περασει λογικα!

ναι είμαι call of duty fanboy αλλά έπαιξα κ τερμάτισα το BD2 αλλά το MW2 το αγόρασα(γιατί βαρέθηκα να περιμένω να κάνουν update τα online κρ_κ lol )

Υπόψην πως το MW2 πωλείται και μέσω Steam (που δεν υπολογίζεται πόσα <<κομμάτια>> είναι)

Μάλιστα, 2 εκ. κατέβασαν map packs..

Και μηδέν πωλήσεις να έχει στο PC, καρφάκι δεν τους καίγεται (δυστυχώς)

Report: Modern Warfare 3 Coming This November

Activision calls in reinforcements.

 

A third game in the Modern Warfare series is coming this year, according to a new report from the Los Angeles Times.

 

Citing unnamed sources, the LA Times says Activision has recruited Sledgehammer Games, the studio currently working on another unannounced Call of Duty title, and Raven Software (Singularity) to help finish development of Modern Warfare 3 for release this November.

 

The report states both Sledgehammer and Infinity Ward are equally completing the single-player portion of the game, while Raven is working on its online multiplayer features.

 

Due to the developer collaboration, sources said the Call of Duty spin-off project in development at Sledgehammer, rumored to be set in the future, has now been put on hold.

 

Since Infinity Ward executives Jason West and Vince Zampella were fired from the studio in March, more than 35 employees have left the studio. Activision said recently it has received over 5,000 applicants to fill the vacancies.

 

The publisher has not publicly announced what Call of Duty title would be released this year, but did confirm a new game would be arriving in the back half of 2011.

 

When asked about the report, an Activision representative told IGN, "There's been much speculation recently. We look forward to releasing details for the next Call of Duty in the near future."

έλεος πια με τη σύγκριση των 2 παιχνιδιών...τις πωλήσεις του mw2 σε όλες τις πλατφόρμες το bc2 τις βλέπει με τα κυάλια...

και ναι το online του bc2 είναι πολύ-πολύ καλύτερο απο αυτό του mw2, αλλά το single του mw2 τα σπάει ενώ του bc2 είναι απλά ανεκτό..

+1 και στο spec-ops του mw2..και όχι δεν είμαι φανμπόι και τα 2 αυθεντικά τα έχω απλά το ένα το λιώνω στο spec-ops και το άλλο στο online
